In recent years there has been a significant increase in family disputes relating to contested wills, trusts and probate. For this reason, Davies and Partners has launched a new, dedicated Contentious Probate and Trusts Department, to provide clients with a specialist service to help resolve these often highly complex claims.
The new Contentious Probate and Trusts team is headed up by Emma Walker (pictured) who is a Senior Associate Solicitor and Court appointed Professional Deputy. Emma has over 15 years of litigation experience, with particular expertise in claims made under the Inheritance (Provision for Family and Dependants) Act 1975.
Losing a loved one is difficult, and dealing with disputes over their estate can be extremely challenging for all involved. There are several factors believed to be fueling the annual rise in such disputes, including poorly written DIY wills, an ageing population and greater mental capacity issues, complex family structures with more divorce, separation, remarriages and cohabitation, and the rise in property prices making estates more profitable.
